Agency comments

Debarment was proposed because on September 1, 2020, Channing Strother (STROTHER), Chief Administrative Law Judge, issued a U. S. Department of Agriculture (USDA) order to CMF (for CMF’s failure to pay assessments from 2017 to 2019) to pay $89,246.55 to the Mushroom Council and $5,000 to the Treasurer of the United States. On November 9, 2021, STROTHER issued a USDA order for CMF’s failure to pay assessments from January 2020 to November 2020, and he ordered CMF to pay $24,812.53 to the Mushroom Council and $5,000 to the Treasurer of the United States. CMF’s ongoing failure to pay debts owed to the government or instrumentally the Mushroom Council, misconduct for failing to pay required assessments, failure to maintain records, and report required information to the Mushroom Council on eleven occasions established causes debarment governmentwide debarment under 2 C.F.R. § 180.800(d), as this misconduct constituted a cause of so serious or compelling nature as to affect present responsibility.
